May 2017: Defense verdict in Anne Arundel County Circuit Court where it was alleged that an internist misread an EKG and that plaintiff suffered from a fatal heart attack.

May 2017: Defense verdict in Montgomery County Circuit Court where it was alleged that the defendant cardiologist failed to recognize the symptoms of a hemorrhagic stroke and where plaintiff suffered from a life-altering hemorrhagic stroke.

May 2017: On May 1, 2017, the Firm opened a fourth office location and its first in Virginia. The new Fairfax, Virginia office is staffed by attorneys Stephen L. Altman and Judd P. Altman and their assistants.

May 2017: Shareholder Dan Costello was named the 2017 Defense Lawyer of the Year by the D.C. Defense Lawyers’ Association.

March 2017: Multiple summary judgments in Maryland and in Delaware in favor of manufacturers of asbestos-containing brake linings alleged to have caused mesothelioma and lung cancer in a variety of occupational and home settings.

March 2017: Managing Shareholder D. Lee Rutland has become a Fellow of the American College of Trial Lawyers. Founded in 1950, the College is composed of the best of the trial bar from the United States and Canada. March 2017: Defense verdict in Baltimore City Circuit Court in case alleging the negligent release of 300+ gallons of heating oil into the basement of a commercial office building resulting in over $1.6 million in alleged economic loss.

March 2017: Defense verdict in Prince George's County where it was alleged that the defendant ER physician failed to timely detect and appropriately treat a fatal heart attack in a 28 year old male patient.

March 2017: Defense verdict in Anne Arundel County Circuit Court physician in malpractice case alleging that a spinal fusion was unindicated.

January 2017: Defense verdict in Prince George's County Circuit Court for an OB/GYN alleged to have injured the small bowel during a laparoscopic surgery with the final result being the death of the patient.

December 2016: Shareholder Bob Klein has published the 32nd annual supplement of his highly popular two-volume treatise, Maryland Civil Procedure Forms with Practice Commentary (published by Matthew Bender & Company).

October 2016: Defense verdict in favor of a Baltimore City hospital in 45 minutes after a two-week trial involving the death of a 28 year-old male who presented to the Emergency Department complaining of chest pain and eventually suffered a cardiac arrest prior to any assessment by the hospital personnel.

August 2016: Shareholders David Levin, Robert Dale Klein, David Roling, and Michael Wiggins once again were voted by their peers as “Maryland Super Lawyers” (2017 edition). Michelle Mitchell and Michael Wharton. Shareholder Timothy Fisher and Associate Tiffany Randolph again were voted “Rising Stars” by their peers.

August 2016: Shareholders David Levin, Lee Rutland, Daniel Costello, and Michael Wiggins again have been selected by their peers for inclusion The Best Lawyers in America® (2017 edition) in the practice area of Medical Malpractice Law – Defendants.

July 2016: At the conclusion of a 9-day trial, a Baltimore County jury returned a defense verdict in favor of the Firm’s anesthesiology clients in a wrongful death/survival action seeking in excess of $1.3 million in damages for a 76-year-old patient who underwent an epidural peripheral anesthesia/nerve block for operative and post-operative pain management for a right total hip arthroplasty.

July 2016: A D.C. Superior Court jury returned a verdict in favor of two physicians and a hospital at the end of a 4-week trial involving allegations of negligence in monitoring a patient's neurological status following a subarachnoid hemorrhage leading to a severe stroke and permanent severe neurologic disability.

April 2016: Defense verdict in Baltimore City for a hospitalist alleged to have failed to diagnose an aortic dissection in a 65-year old patient presenting with severe chest pain and associated symptoms. The patient was admitted to the hospitalist service with orders for a stress test and echocardiogram to be performed the following morning. Prior to the performance of these studies, the patient died of cardiac tamponade from a rupture at the aorta arch.

April 2016: After 2 weeks of trial a D.C. Superior Court jury returned a verdict in favor of the defendant ophthalmologist in a case alleging a negligent delay in the diagnosis and treatment of post-cataract surgery endolphthalmitis resulting in loss of vision and removal of the infected eye.

February 2016: Electrical equipment manufacturer dismissed with prejudice from federal court lawsuit filed by industrial plant worker who claimed $9 Million for personal injuries allegedly caused by product design and manufacturing defects.

January 2016: Defense verdict in the Circuit Court for Prince George’s County in favor of a hand surgeon accused of a negligent repair of the flexor digitorum profundus tendon of the right middle finger. Alleged negligence was asserted to have caused Plaintiff to lose his job with a resultant economic loss of over $4 million.

January 2016: U.S. News - 2016 Edition has ranked Wharton Levin Erhmantraut & Klein among the “Best Law Firms” in the United States for the defense of personal injury litigation.

August, 2011: Shareholder Robert Dale Klein is a contributing chapter author to the comprehensive book: "Managing E-Discovery and ESI: From Pre-Litigation Through Trial" published by the American Bar Association in July 2011.
